1. Services Provided

d’Arch Residential Design, LLC provides residential drafting, building design, construction planning, consulting, and related design services.

Services may include conceptual drawings, permit drawings, 3D renderings, drafting support, and coordination with consultants.

Services provided through this website do not constitute licensed architectural or engineering services unless specifically stated in a written agreement.

2. Website Information

All information contained on this website is provided for general informational purposes only.

While we strive for accuracy, we make no guarantees regarding completeness, accuracy, or suitability of information presented.

3. Permit Approval Disclaimer

Permit approval is subject to local building department review and jurisdictional requirements. Approval cannot be guaranteed.

4. Engineering & Consultant Services

Structural engineering, civil engineering, mechanical, electrical, plumbing, geotechnical, surveying, and other consultant services are not included unless specifically identified in a written agreement.

Where required by local jurisdiction, licensed engineers or consultants shall provide design and review services under separate agreement or additional fee.

5. Client Responsibilities

• Providing accurate property information and dimensions
• Verifying property boundaries, easements, and HOA requirements
• Obtaining property surveys when required
• Reviewing all drawings prior to approval or construction
• Communicating desired revisions promptly

6. Contractor Responsibilities

• Verifying all field dimensions and existing conditions
• Following applicable codes and manufacturer requirements
• Maintaining jobsite safety
• Coordinating construction means, methods, and sequencing

d’Arch Residential Design, LLC is not responsible for construction means, methods, scheduling, safety procedures, contractor performance, or field supervision unless specifically contracted in writing.

7. Changes & Revisions

Revisions beyond the original agreed scope of work may result in additional fees.

Changes requested after project approval, permit submission, engineering completion, or commencement of construction may require additional redesign and consultant coordination fees.

8. Payment Terms

Payment terms shall be defined within the project proposal or service agreement.

Failure to make payments when due may result in suspension of services, withholding of deliverables, or termination of project work.

All completed drawings, renderings, and deliverables remain property of d’Arch Residential Design, LLC until full payment has been received.

9. Intellectual Property

All drawings, renderings, plans, graphics, website content, and design materials produced by d’Arch Residential Design, LLC are protected by copyright laws and remain the intellectual property of d’Arch Residential Design, LLC unless otherwise agreed in writing.

No documents may be copied, reused, modified, distributed, or transferred to third parties without written permission.

Reuse of drawings for additional projects or properties without written authorization is prohibited.

10. Limitation of Liability

To the maximum extent permitted by law, d’Arch Residential Design, LLC shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from use of the website, drawings, design services, or project-related materials.

Total liability for any claim arising from services provided shall not exceed the amount paid by the client for the specific service rendered.

11. Third-Party Consultants

d’Arch Residential Design, LLC may coordinate with third-party consultants, engineers, contractors, or permit agencies as part of the project process.

However, we are not responsible for the actions, errors, omissions, schedules, or services of third parties.

12. No Warranty

Services and website materials are provided “as is” without warranties of any kind, express or implied.

13. Termination of Services

Either party may terminate services in writing.

Client shall remain responsible for payment of all completed work and reimbursable expenses incurred up to the termination date.

14. Governing Law

These Terms & Conditions shall be governed by and interpreted under the laws of the State of Idaho.

Any disputes arising from use of this website or services shall be resolved in the appropriate courts located within the State of Idaho.

15. Privacy

Use of this website may involve collection of contact information submitted voluntarily through forms or email communication.

Information submitted will not be sold to third parties.
